Michigan Attorney General Dana Nessel has filed a briefin support of the city of Traverse City to build a “fish pass” without requiring a city vote.
The city’s proposed “fish pass” would reconnect the Boardman River with Lake Michigan and allow native fish species to cross Union Street Dam.
The project was put on hold last year after a circuit court judge sided with a citizen, saying the city must hold a vote before moving forward.
In her amicus brief, Nessel says Traverse City is not required to hold a vote based on its city charter. She says FishPass is an important infrastructure project that will prevent downtown from flooding and reduce the spread of invasive species.
The issue will go before the Michigan Court of Appeals next month.
