Opponents of Nestle’s use of water in Osceola County got a legal setback today.
An environmental group and the Grand Traverse Band of Ottawa and Chippewa Indians had challenged a permit giving the bottling company the right to nearly double the water they can pump at the site.
But Michigan’s Department of Environment, Great Lakes, and Energy dismissed the case Friday,
They say the groups should have appealed the decision in circuit court.
“Of course we're disappointed but we're not surprised that EGLE is kicking it down the road and trying to send us off to circuit court.”
Peggy Case, President of Michigan Citizens for Water Conservation, is figuring out whether the group can mount another expensive lawsuit.
They’re waiting to hear back from the attorney general office on a separate complaint against Nestle.
