Hearings over Whitmer's emergency measures scheduled for next month

The Michigan Supreme Court has scheduled oral arguments in a lawsuit over Governor Gretchen Whitmer’s emergency measures to slow the spread of COVID-19.

Three west Michigan health centers and a patient are suing the governor, Attorney General Dana Nessel and the state health department.

The case centers on two questions – whether the governor had the authority under state law to issue or extend any executive orders after April 30th and whether the emergency management law violates the separation of powers clause in the Michigan Constitution.

Lawyers on both sides will make their cases in a Zoom video conference on September 2nd.
