Today [Thursday] Michigan’s Secretary of State lost another round in court as she tries to ban the open carry of guns at polling places next week.
The Michigan Court of Appeals rejected Secretary of State Jocelyn Benson's appeal of a Court of Claims ruling that she exceeded her authority in prohibiting the open carry of guns within 100 feet of a polling place.
The lower court found Benson’s policy didn't go through a formal rule-making process required under Michigan law.
Benson wants to ban firearms at polling places as a way to prevent voter intimidation.
But the appeals court says voter intimidation already is illegal.
Attorney General Dana Nessel’s office says she’ll appeal the decision to the Michigan Supreme Court
