This week, the Michigan Court of Appeals considers just how long after Election Day officials may count absentee ballots.
Last month a Court of Claims judge ruled that clerks must count ballots postmarked up to the day before the November 3rd election and delivered within two weeks.
The judge noted there have been numerous delays in mail delivery during the ongoing pandemic.
But Michigan’s Republican-controlled state legislature is appealing the order.
Typically, absentee ballots in Michigan are only counted if they arrive by eight p.m. on Election Day.
Republican officials say extending the deadline to count ballots violates the state’s constitution.
