Michigan Attorney General Dana Nessel is continuing to challenge the constitutionality of a state agreement with Enbridge energy to build a tunnel to house the line 5 pipeline.
The agreement was approved under then-Governor Rick Snyder. Last March the Attorney General ruled the agreement was unconstitutional.
In response Enbridge sued the state in the Court of Claims, which ruled that the agreement was constitutional. It is that decision Dana Nessel is now hoping to overturn.
Separately, a Court of Appeals panel has denied the state’s motion for a stay, pending the appeal. That means the tunnel plan can move forward despite ongoing litigation.
A spokesperson for Enbridge said it’s time for the state and Enbridge to move forward together with the Great Lakes Tunnel Project.
